JCM wins German patent battle
The German Federal Patent Court issued a nullity judgment against Mars Inc/MEI Inc. in July, declaring patent EP 0 026 775 (DE 693 06 231) claims 26, 27 and 28 to be invalid for the territory of the Federal Republic of Germany. The judgment, awarded in favor of JCM, requires Mars Inc./MEI Inc. to bear all costs of the procedure in the amount of 120 percent of the enforceable amount.
Mars Inc/MEI Inc. had sited the same claims 26, 27 and 28 against JCM in a 10 million Euro patent infringement lawsuit in a German District Court.
Another patent infringement case is pending in a United States District Court involving essentially the same claims of an equivalent US Patent.
