UK tax Tribunal rules in favour of Rank

The Rank Group, which operates Mecca Bingo clubs and Grosvenor Casinos in the UK, could be in line for tax refunds totalling over £60 million following two VAT Tribunal rulings.

The company has claimed that it overpaid tax of £25 million on gaming machines and £36.3 million on games of interval bingo, and has won rulings in its favour on both counts, which could encourage other operators in the UK to bring similar claims.

The second stage of litigation on the £25 million claim is due to start later this year, but the Tribunal has indicated that there is a strong likelihood that the case will be referred to the European Court of Justice, so the final decision may not be made until 2009.

The claims centred on European Union rules concerning fiscal neutrality, and related to differential taxation on machines dependent on the location of the RNG.
