Patent row: Elixir looking for $millions in damages
Elixir Gaming has issued a statement saying that it intends to chase Shuffle Master for millions of dollars in damages as a result of a patent infringement action brought by Shuffle Master.
Shuffle Master has dropped its appeal of the judgment entered by the United States District Court, which went against Shuffle Master and in favour of Elixir Gaming (formerly known as VendingData Corp) on Shuffle Master's lawsuit for patent infringement involving the Poker-1 product. Shuffle Master now claims Poker-1 has become a "commercial failure".
Pointing out in a statement that the district court's judgment in favour of Elixir Gaming is final, and that the preliminary injunction previously obtained by Shuffle Master (and later reversed by the Court of Appeals) was wrongful, Elixir Gaming plans to seek payment for damages caused by what it regards as Shuffle Master's wrongful preliminary injunction.
Elixir will also claim for attorneys' fees caused by the wrongful prosecution of the misguided patent infringement case against the Company. It estimates the total potential damages could run into millions of dollars.
