Poker plaintiffs are trumped by T&Cs
Two Ohio residents learned that it pays to read the terms and conditions after their lawsuit against online gaming operator Party Poker failed.
A federal court in Ohio rejected their class-action claim that they and others had lost money playing with Party Poker because other players had colluded against them. They claimed that Party Poker was aware of the collusion but did not act to stop it.
However, the court – rather than ruling directly on the merits of the case – noted that Party Poker’s terms and conditions state that all disputes will be settled by the courts of Gibraltar, and concluded it had no jurisdiction in the matter.
